The leadership of the National Association of Resident Doctors (NARD) has faulted the ruling of the National Industrial Court (NIC) directing its members to return to work.

A communique jointly signed by NARD President, Dr Uyilawa Okhuaihesuyi, and the union’s Secretary-General, Dr Jerry Isogun, on Friday revealed that the doctors had begun the process to appeal the ruling.

“As we are all aware, especially those that were present in court today (Friday), the NIC has given a ruling on the application for interlocutory injunction filed by the Federal Government,” the statement said. “We are not satisfied with the ruling.

“After consultations with our lawyers, we have instructed our lawyers to appeal the ruling and file an application for stay of execution.”

The statement is in reaction to the ruling of Justice Bashar Alkali who ordered the resident doctors to suspend their ongoing industrial action and return to work immediately, pending the determination of the substantive suit.

Justice Alkali who ruled on an application by the government had also directed parties in the matter to return to the negotiating table, saying no amount of money could compensate for the loss of lives as a result of the impasse.

In demonstration of its displeasure with the decision of the court, NARD instructed its lawyers to file necessary processes, rather than ask members to return to their duty posts.

It also asked the doctors to remain calm and resolute, saying “everything depends on our firm resolve.”

“We are committed to protecting your rights within the confines of the law. We believe justice shall be ours ultimately,” the union told its members.

It stated that the court had reserved ruling on which application it would take first on Wednesday, and its lawyers argued that the court ought to hear and determine the Notice of Preliminary Objection (NPO) filed by the doctors to challenge the jurisdiction of the court before taking the application for an interlocutory injunction or any other application.

The union added that the court adjourned ruling on the argument on the matter until Friday, after which it ruled that it would take the government’s application for interlocutory injunction first while its NPO would be taken and determined along with the substantive suit.

“Also, our lawyers drew the attention of the court to our application for stay of execution of the ex parte order and that the court should take that application first. The court insisted that the government application would be taken first.

“On 15/9/21, the court ordered all parties to resume negotiations. The government refused to resume negotiations in line with the order of 23/8/21. Our lawyers reported this development to the court. We have demonstrated good faith and would continue to do so,” the statement said.

NARD accused the court of denial of a fair hearing by refusing to hear and determine its NPO before taking the government’s application for interlocutory injunction.

I have no problems with people’s political affiliations but I have issues with the manner the confidence and goodwill of Nigerians are being gambled with recklessly by clueless political elites.

“Could recruitment of political liabilities in the face of raving insecurity that has claimed lives of many innocent Nigerians who voted for us be the priority now?

“What has happened to the humanity of APC leaders that we are so insensitive to the mode of the nation? If we have such political strategies of conquering political opponents like Femi Fani-Kayode, then why have we failed to deploy the same to defeat Boko Haram, banditry, unknown gunmen, kidnapping?”

He lamented that the mission of APC that they formed in 2015 had changed, adding that people now joined the party to get “juicy appointments.”

The fear of APC is the beginning of wisdom, once a corrupt politician joins APC his sins are forgiven; all corruption charges will be automatically dropped and compensations with juicy appointments will follow.

“Loyalty in the APC party is a capital offence, no wonder Femi Fani-Kayode insulted President Buhari and swore he will prefer to die than joining APC.

Gunmen have killed Abubakar Abdullahi, the chairman of the Miyetti Allah Cattle Breeders’ Association of Nigeria in the Lere Local Government Area of Kaduna State.

The attack happened in the early hours of Friday according to the Director of Media and Publicity of MACBAN in Kaduna State, Ibrahim Bayero-Zango.

According to Punch, the MACBAN’s spokesman stated that the attackers stormed the home of the chairman, popularly known as Dambardi, in Lere town at about 1am.

He added that the gunmen demanded N20million from him before he was whisked away to where he was later killed along the Saminaka-Mariri-Zango highway.

He said, “Early this morning, one of our members called to inform the leadership of the state branch of MACBAN that at about 1:00am (Friday), unknown gunmen attacked the home of the chairman of MACBAN in Lere LGA and killed him.

“When they arrived the house at about 1:00am, they demanded the sum of N20m from him in order to spare his life but he told them he had no such money.

“Although he was able to raise N250,000 for the assailants, they took him to the back of the town along the Saminaka-Mariri- Zango highway where they shot him dead.”

The MACBAN spokesman, while condemning the attack, called on the state government and security agencies to investigate the attack so as to uncover the perpetrators of the heinous act.

“We totally condemn this heinous act and we are appealing to the state government and the Police to thoroughly investigate the attack and fish out the perpetrators of the attack.

“This is because Lere is one of the peaceful areas in the state where there has been no issue of herder-farmer crisis.

“There has been no issue of cattle rustling in the area but, surprisingly, somebody like the slain chairman of MACBAN, a strong supporter and promoter of peace in Lere, could be so brutally gunned down in that manner.

“We are sad over the incident,” he added.

The Department of State Services (DSS) has said that it is yet to be informed about the court judgment directing the service to pay N20billion to Yoruba Nation activist, Sunday Adeyemo, also known as Sunday Igboho.

The spokesman of DSS, Peter Afunanya, who was asked for the service’s reaction to the court order, told Daily Trust that the court possibly had not informed the secret police.

“The court possibly has not informed us. So, my official response is that I don’t have any comments,” he said.

An Oyo State High Court on Friday granted a relief sought by the Yoruba Nation activist, Igboho, and ordered the Nigerian government to pay him N20billion.

The court also dismissed an application filed by the Attorney General of the Federation and the Minister of Justice, Abubakar Malami, challenging its jurisdiction to hear allegations against the Nigerian government agencies.

The court was expected to deliver judgment or ruling on the N500billion fundamental human rights case instituted by the Yoruba Nation activist against the Nigerian government and the DSS.

Igboho through his lawyer, Yomi Alliyu, filed a suit challenging the invasion of his house in Ibadan on July 1 by operatives of the DSS, also known as the State Security Service (SSS) or secret police.

Igboho, among others, sought an order of the court to declare the invasion of his residence by DSS operatives as illegal and an infringement on his fundamental human rights.

The three respondents are; the Attorney-General of the Federation and Minister of Justice, Abubakar Malami (SAN), as the first respondent, the DSS as the second respondent and the DSS Director in Oyo State as the third respondent.

Counsel for the AGF, Abubakar Abdullahi had filed an application challenging the ability of a state High Court to hear the activities of Nigerian government agencies.

But citing several judgments by the Supreme and Appeal courts in respect of the ability of the state high court to hear such cases, Justice Ladiran Akintola said the invasion of the house of the applicant violated his fundamental human rights as stipulated in the Constitution of the Federal Republic of Nigeria, 1999 as amended.

"Unfortunately, this court is not a Father Christmas and cannot award the sum of N500billion as requested by the applicant but the court retrained the respondents from arresting or harassing the applicant. He has right to his free movement as contain in section 35.1 (a)(b) of the 1999 constitution as amended," the judge had added.

An Oyo State High Court sitting in Ibadan, the Oyo state capital on Friday noted that every Nigerian has right to self-determination without being intimidated or harassed by the security agencies.

Justice Ladiran Akintola stated this while delivering judgement in a case instituted by the Yoruba Nation agitator, Chief Sunday Adeyemo, popularly called Sunday Igboho against the Nigerian government and the Attorney General of Federation, Abubakar Malami.

This followed the raid on Igboho's Ibadan residence on July 1 during which the Department of State Services (DSS) killed two persons and arrested 12 others. 

Aside from ordering the Nigerian government to pay Igboho a sum of N20 billion as compensation instead of the N500 billion demanded by the petitioner, the court restrained the Nigerian government from harassing, intimidating or arresting the separatist leader.

The judge dismissed the primary objection of the respondents which challenged the jurisdiction of the court in hearing the case.

Counsel for Igboho had approached the court in July to challenge the raid on his client’s house by the DSS.

While giving the judgement on the matter, Justice Akintola said, "First respondent files a notice of preliminary objection, objecting the jurisdiction of the court to entertain the case on the grounds that the case cannot be brought under fundamental human rights, that the court lacks the jurisdiction.

"Having carefully considered the first respondent's notice of preliminary objection, together with written submission of the counsel on one hand, and on the other hand, having also considered the written submission of the learned senior counsel to the applicant respondent, this court is of the opinion that the fact of this case, as contained in the affidavit, and further affidavit in support of the originating notice, suggested that the second and third respondents and their agents, invaded the home of the applicant; that interference with the quiet enjoyment of the applicant of his house is trespass, and breached of the private and family life of the applicant.

"In the final analysis, this court finds no merit in the preliminary objection taken by the first respondent applicant in the originating application of the applicant for the enforcement of his fundamental human rights, allegedly violated by the second and third respondents in this case. The same is consequently hereby dismissed.

"This court is unable to rule that the second and third respondents have a competent notice of preliminary objection before this court in this suit. The same is invalid and incompetent, not having been signed neither by the parties nor by their counsel in this suit. Consequently, the purported notice of preliminary objection is accordingly hereby struck out. The same is incurably defective and incompetent in law."

Speaking further on the main suit, Justice Akintola said, "The reckless and indiscriminate shooting undertaken by the second and third respondents and their agents, which resulted in the death of two persons of the applicant, was in itself, a threat to the life of the applicant. Nobody shoots guns in order of entertainment of people. Such a conduct has a serious potential of killing the victim, and at best constitutes a serious threat to the lives of the people.

"It is difficult to believe that the cache of arms and ammunition allegedly recovered from the residence of the applicant really came to bear. Even, for the sake of argument, the defence of the second and third respondents into the relief, that the presumed, they gathered intelligence, that the applicant was in possession of arms and ammunition at his residence, with which to cede the control of the South West to Lagos.

"In the absence of any evidence that Nigeria was in a state of war, the style and procedure adopted by the second and third respondents and their agents in this case, is highly condemnable, repressible, crude and most unprofessional. Every Nigerian has right to self-determination as enumerated in authorities earlier stated.

"With the benefit of the hindsight, given the number of guns, arms allegedly recovered from the premises of the applicant on the fateful night, relative to the harms, damage and deaths, plus trauma inflicted on, not only the applicant, his households, guests, and neighborhood, it is very doubtful if it was worth the exercise at all.

"It was not only the applicant that would have been traumatised by the overzealousness and recklessness of the second and third respondents and their agents. The entire neighbourhood of the applicant's residence was thrown into serious squabbles and troubles.

"The style adopted by the second and third respondents in the case should be condemned in strongest possible terms, especially given the fact that they are maintained by the Nigerian taxpayers. And yet they did not hesitate to unleash such mayhem on a Nigerian citizen, who has not been pronounced guilty of any crime by any court of the land."

The Ghana Union of Traders Association (GUTA) has appealed to the Committee on Foreign Retail Trade, to resume operations to close down shops of undocumented foreign retailers.

The development comes amid purported plans by the Nigerian Union of Traders Association in Ghana (NUTAG) to reject the special dispensation granted them by the Government of Ghana despite a series of diplomatic efforts by both Ghana and Nigeria governments, Ghanaian Times reports.

A statement from Ghanaian Times reads, “This inappropriate attitude of the Nigerian traders in Ghana is not only an insult but also a well-orchestrated ploy to frustrate the committee, state, and people of Ghana. Therefore, we of the Ghana Union of the Traders’ Associations wish to appeal to the Committee on Foreign Retail Trade to, as a matter of urgency resume its operations without any delays as the behaviour of the Nigerian traders has seriously provoked Ghanaian traders and reigniting agitations in the markets.”

Meanwhile, Nkem Tony Onyeagolu, former President for All Nigerians Community- Ashanti Region, has appealed to the President of Ghana, Nana Addo Akufo-Addo to issue a directive for the re-opening of shops owned by Nigerian traders.

Onyeagolu said since the closure of their retail shops by local authorities, things have got worse for some of the Igbo traders in the country.

He explained that the majority of Igbo traders have been victimised by the move and are hard-pressed financially, highly indebted and have not been able to pay off loans they took from financial institutions to run their businesses.

In reaction, NUTAG President, Chukwuemeka Nnaji urged President Akufo-Addo of Ghana, President Muhammadu Buhari of Nigeria, ECOWAS Commission and the international community to “urgently intervene and prevent GUTA from attacking our members as they have promised in their last press release.”

He said the current decision by GUTA comes as a surprise since it had been able to appeal to the Inter-Ministerial Committee of both countries to review the issue.

This is to allow “our members who have not registered with the GIPC to stay out the remaining days, months or years of their tenancy agreement after which they are supposed to pack out because the rent for those shops shall not be renewed and will not be allowed to rent shops anywhere in Ghana.”

NUTAG had been ordered to collect all the business documents of members, including the tenancy agreements of the respective shops or stalls.

According to the Nigerian union, GUTA’s failure to adhere to the review of the concession granted by the two co-chairmen of Joint Implementation Taskforce (JIT), as well as its threat, is unfortunate.

“We are particularly concerned about this latest threat because GUTA has since 2007 been issuing and carrying out attacks against Nigerian traders in Ghana. The use of such violent measures has not ended for any of the traders from the two brotherly countries.

“We are appealing to the President not to succumb to people who want to railroad him into an exercise which is purely an eviction disguised as concession,” the statement said.

They said if GUTA acts on its threat, thousands of Nigerians will be made to suffer going back to Nigeria with little or nothing as many of them had their shops locked for almost two years.

A former Minister of State for Petroleum Resources, Ibe Kachikwu spent over N7 million on hotel accommodation and designer clothes and shoes between August 3 and 4, 2017 in Paris, France, a statement of his bank account for the period reveals.

According to the bank statement seen by SaharaReporters, Kachikwu, a former Group Managing Director of the Nigerian National Petroleum Corporation (NNPC), spent N1,725,518.38 to pay for his accommodation at MCE (Marriott Champs Elysees) Hotel, Paris, France on August 4, 2017.

Kachikwu was replaced by Timipre Sylva as minister in August 2019.

The statement shows Kachikwu also spent N1,130,252.96 on Louis Vuitton products on the same day.

Hours before, on August 3, N2,061,505. 78 was deducted twice –amounting to N4,123,011.56– and credited to Christian Dior. C, a fashion, fragrance and accessories shop in Paris.

The deductions of N2,061,50.78 twice for Christian Dior. C were made on the same day.

On July 18, 2017, N345,313.84 was deducted from Kachikwu's account and sent to Harbour Hotel, Dubai, suggesting he had spent time there.

Less than two weeks later, on July 28, N345,292.48 was deducted from his account, again for Harbour Hotel, Dubai.

On July 27, 2017, N2, 671,479.69 was deducted from Kachikwu's account and credited to CDC Abu Dhabi Couture, Dubai, suggesting another lavish spending on clothes.

His 2016 statement of account shows Kachikwu also patronised Hermes, French luxury goods manufacturer that specialises in leather goods, lifestyle accessories, home furnishings, perfumery, jewellery, watches and ready-to-wear. He spent N672,008.35 on December 7, 2016 to pay for something he had bought from Hermes with his debit card.

On November 30, 2016, there was a debit of about N3.5 million from his account which was credited to Tom Ford, Dubai. This also appears twice for the same day.

On December 19, 2016, he bought jewellery worth N632,606.21 from Marhaba in Dubai and the following day he paid N633, 897.41 to The Harbour Hotel, also in Dubai.

Aside from the many debits exposing Kachikwu's flamboyant lifestyle, some transactions also suggest his account may have been used to launder money. On February 15, 2016, Kachikwu’s account was credit with N9,777,176,145.000 (about N10 billion), with the description- 8904150000073: Closure Pro. There was a debit of N9,785,865,665.27 from the account, with the description Dr Tran for funding A/c 89041500.

On March 24, 2016, his account was credited with over N103 million with the description Private BA.

On 14 of January, 2016, N50,000,000.00 was transferred to Kachikwu with “8904010006095 : Closure”. Also on February 18, 2016 about N394,614,000.00 (about N400 million) entered his account with “VC REPAYMENT AS” as description.

N10,000,000 in four tranches were also transferred to him from AVA & AUDREY LIMITED on April 18, 2017.

Another N10,000,000.00 was also transferred to him from one AYODEJI TOLUWALASE on April 18, 2017.

And on April 28, 2017, he received N60,000,000 with a description that says: 8904010008372 Closure Pro.

Known for his lavish lifestyle, Kachikwu as Minister allegedly spent over N182 million on a chattered flight to China for a three-day roadshow in the Asian country to attract investments to Nigeria's oil and gas sector.

The Northern Youths Leaders Forum has said Nigeria cannot have progress if its leader, President Muhammadu Buhari is physically and spiritually caged.

The NYLF President, Elliot Afiyo revealed this in Yola, the Adamawa State capital on Friday while speaking on the defection of a former aviation minister, Femi Fani-Kayode from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC).

He said that the group was not surprised to see Fani-Kayode's defection from the PDP to the ruling party.

According to him, the former minister is entitled to use his only available political weapon, which is his tongue, to eat.

The group said it was confident that none of the governors who received its endorsement to contest for the presidency would ever defect to the APC.

Afiyo said, “We want to clearly state, without mincing words, that Senator Bala Mohammed has not and will never defect to APC. He has never, at any time, discussed the issue of defection with FFK.

“The country is sinking and there is the need for patriots and everyone to come together to rescue the country against the conspiracy by a few elite, of which FFK, by his actions, is a prominent member.

“The signs are not hard to see; Buhari is caged spiritually and physically. This is because there is a conspiracy against Nigeria by some Nigerian conspirators. If not, how do you explain the defection of Femi Fani-Kayode into the APC?”

Afiyo appealed to Nigerians not to be distracted or discouraged, adding it is apparent that the President and his party have failed Nigerians.

“We should not be distracted, discouraged or in despair because of people that are identifying with conspirators because of a pot of porridge. We will surely sing hallelujah in 2023 by His grace,” Afiyo stated.
